Terms of Service

These terms are a contract between you and Sway Athletics("we", "us"), operator of Dugout Hero (the "Service"). By creating an account or using the Service, you agree to these terms. You must be of legal age in your jurisdiction, or have authority to bind the organization you represent.

Dugout Hero is a scorekeeping, roster, and stats tool for adult slow pitch softball, including USSSA and GSL rule sets. Free accounts have limited functionality; Pro plans unlock full season and tournament tracking.

• Provide accurate information and keep it current.
• Keep your credentials confidential; you are responsible for activity under your account.
• You retain ownership of the content (rosters, games, stats) you upload; you grant us a limited license to host and process it to provide the Service.

You must not:

• Use the Service unlawfully, for fraud, spam, or harassment.
• Infringe intellectual property or privacy rights of others.
• Interfere with security, probe, scrape, or introduce malware.
• Reverse engineer, resell, or redistribute the Service.

Our order process is conducted by Stripe, Inc. Sway Athletics is the seller of record. Stripe processes payments, calculates and collects applicable taxes, and manages subscription billing on our behalf. Payment terms, billing, taxes, cancellation, and refund mechanics are governed by Stripe's terms and our Refund Policy. Subscriptions renew automatically until cancelled; the Season Pass is a one-time purchase granting 365 days of Pro access.

We retain all right, title, and interest in the Service, including software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service under your selected plan.

The Service is provided "as is". We do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends; we may delete account data after a reasonable export window.

To the extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where prohibited by law.

You will indemnify us against claims arising from your content, your use of the Service in violation of these terms, or your unlawful conduct.

We may update these terms. Material changes will be notified via the Service or by email. Continued use after changes means you accept them.

These terms are governed by the laws of the jurisdiction where Sway Athletics is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.
